1. Introduction This website is operated by BlaqPearl. Throughout the site, the terms “we”, “us” and “our” refer to BlaqPearl. BlaqPearl offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

2. General Conditions We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

3. Products and Services

  • Availability: Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

  • Image Accuracy: We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

  • Prescription Eyewear: By placing an order for prescription lenses, you warrant that the prescription details provided are valid, accurate, and less than 24 months old (or as required by your optometrist). BlaqPearl cannot be held liable for eye strain, discomfort, or vision issues resulting from incorrect prescription data entered by the customer.

4. Accuracy of Billing and Account Information We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

5. Logistics and Delivery

  • Courier Partners: We utilize The Courier Guy and PUDO locker systems for our deliveries.

  • Risk of Loss: The risk of loss for products passes to you upon delivery of the products to the carrier.

  • Delivery Times: While we strive to meet all delivery estimates, timelines provided are estimates and are not guaranteed. Prescription eyewear requires additional manufacturing time (lab time) before dispatch.

6. Returns and Refunds Your purchase is subject to our Return and Refund Policy, which forms part of these Terms of Service.

  • We offer a 14-day return window for fashion/non-prescription eyewear.

  • Prescription lenses are custom-made and are exempt from standard returns unless defective or incorrect due to a laboratory error.

7. Third-Party Links Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

8. Personal Information Your submission of personal information through the store is governed by our Privacy Policy and is processed in accordance with the Protection of Personal Information Act (POPIA).
